Terms of Service
By purchasing a Plan, Client has read and agrees to these Terms of Service and accepts all serving as a binding contract and agreement between Budget Graphic Design (BGD) and Client. The following business day after purchasing a plan, Client will receive a PDF copy of the Terms of Service to sign and date along with a project brief to complete and return within 2 business days.
Payment
All Plans/sales once submitted via online checkout or any payment received by BGD are final. Before submitting a payment, it is suggested, Client has conducted all communication necessary with their own stakeholders and contacted BGD with any questions about projects and/or service offered.
Payment for Plans may be made online at Budgetgraphicdesign.com via the Plan link or by check. BGD will email invoice to Client if paying by check. Check must be mailed 2 business days after invoice date. Once BGD receives check payment, project(s) will resume.
Payment for custom hours or the *50/50 payment option-Gold and Platinum Plans only; may be made via online merchant or by check. BGD will email invoice to Client. Online payment via link must be made 2 business days after invoice date and check must be mailed 2 business days after invoice date. Once BGD receives payment/check, project(s) will resume.
Payment for projects being produced/printed with a print vendor may be made via online merchant or by check. BGD will email invoice to Client. Online payment via link must be made 2 business days after invoice date and check must be mailed 2 business days after invoice date. Once BGD receives payment/check, project(s) will resume, will not be reversible and will go into print production.
Non-refundable
Due to the nature of creative/graphic design work and hours set by each Plan, refunds of any amount are not available, no exceptions. By chance of, any unused hours are also not refundable. If you are unsure which plan is right for you or prefer (custom hours at 9 hours minimum), please contact BGD. In the event of any unused hours left, BGD will work with Client and find a solution to fulfill.
Client agrees not to initiate or submit any form of chargeback claim(s) or dispute to Clients credit card bank/merchant that was used for payment(s) in attempt to recoup or reverse any or all amount paid at any time for BGD Plans/hours of service or print materials ordered, purchased/produced. All sales of BGD are final. In the event so, Client agrees to pay 100% of all BGD legal and any other related fees/costs incurred for BGD to recover/defend losses (including total amount in chargeback claim) related to a Client chargeback claim.
Default
Any online/merchant payment not received from Client to BGD past 30 days or (check or returned check 2 weeks after 30 days) is considered default. BGD reserves the right to then cease and/or cancel all related project(s) at the discretion of BGD. BGD will help to resolve any such payment issue if Client acts in good faith.
Project and Plans
After a Plan is purchased, Client will receive a short project brief/questionnaire to complete and return to BGD via email within 2 business days. This will include a copy of the Terms of Service and Client must sign and date to also return. Please contact BGD if any questions.
If a kickoff call is requested, Client should indicate on the project brief with a few options of their availability. BGD will then follow up by email and schedule a day and time based on those options.
Client agrees to reply with all communication including feedback and edit requests during project(s) in progress within 2 business days in order to keep projects moving towards completion.
Each Plan should be completed in a timely duration as follows:
Lite – 8 hours: to be 100% completed in approximately 10 business days from purchase date.
Bronze – 40 hours: to be 100% completed in approximately 15 business days from purchase date.
Silver – 80 hours: to be 100% completed in approximately 20 business days from purchase date.
Gold – 120 hours: to be 100% completed in approximately 25 business days from purchase date.
Platinum – 160 hours: to be 100% completed in approximately 30 business days from purchase date.
Contact BGD by email for a request of custom hours. 9 hours minimum required. Please describe your project design need i.e. logo design, print design, digital design, etc. BGD will reply with a flat fee cost estimate to Client. Custom hours include stock photos/images and unlimited edits.
Depending on the project type, BGD aims to send deigns/files to review within 2-3 business days (or less). However depending on project types, schedule conflicts, time out of office, holidays and unforeseeable circumstances, BGD reserves the right to extend its communication and delivery of designs/files to review. Client will be notified in advance or as best possible pending the situation. If Client incurs any schedule conflicts, time out of office, holidays and unforeseeable circumstances, BGD simply asks Client to communicate to BGD in advance or as best possible pending the situation.
BGD will communicate remaining balance of hours to Client throughout the project.
Client agrees not to make excessive call requests during a project(s) and will give ample time ahead of a call requests. BGD reserves the right to decline a call request as sees fit.
Hours are calculated and managed by BGD. Client understands quality design can take time as noted in section: Level of expectation on creative work/design(s).
Sign-offs and proofing are required by Client and projects are considered final and 100% complete once a sign-off is received by BGD from Client.
Quantity of stock photos/illustrations/media/assets may be limited pending on Client requests.
BGD will coordinate and manage requests within the scope of the project, in an order it sees fit to best accomplish and complete such various requests.
Should a project need to exceed original hours purchased due to Client change orders or any other factors from Client during a project(s) in progress, BGD will first communicate to Client an estimated number of hours needed and estimated flat fee cost to finish the project(s) and BGD reserves the right to bill for any additional hours necessary in order to finish the Client project(s) with Client approval of. Payment must be received by BGD in order for project(s) to resume.
Level of expectation on creative work/design(s)
Discrepancy/complaints from Client to BGD regarding hours spent by BGD or quality of creative work/design(s) delivered by BGD is not permitted. BGD offers a professional level of creative work/design(s) as seen in the project examples on budgetgraphicdesign.com with fair and reasonable hours determined and allocated by BGD in order to develop Client projects. If client raises any issue on quality of creative work/design(s) outside of typical edit requests, BGD will continue to evolve creative work/design(s) to satisfy any concern and hours will still be deducted from the Plan purchased or custom hours purchased. If BGD is at fault for missing an edit request to creative work/design(s), Clients hours will not be deducted and BGD will correct the edit at no charge in time/cost. Creative work/graphic design is an evolving process that requires reasonable time for professional level output and Client understands and agrees to. BGD does everything possible to make our Clients happy.
Print service
At the request of the Client, BGD can offer to have materials produced, printed and shipped via a vendor of BGD choice. This is a separate cost to Client from a Plan purchased or custom hours purchased. An invoice will be sent to Client to be paid in full for the amount quoted before any project will be sent to print production. Once BGD receives payment, BGD will proceed with print production process. Client agrees to communicate and conduct project related print requests in a timely manner in order to properly deliver final materials on time. BGD will give time estimates as best possible but can not be held responsible for vendor, shipping or any delays uncontrollable.
Client must proof all files, copy/content and sign off within 2-3 business days of receiving proofs before project(s) are sent to print production. BGD will assign a print/production vendor to use. Should a Client prefer to use their own print/production vendor, BGD can work with that source and BGD will supply necessary digital files. BGD will not be responsible for any issues after supplying digital files if a Client uses their own vendor. Should a Client’s vendor request BGD make edits to any supplied digital files from BGD, BGD will make every attempt to do so at no charge to Client.
Should any print materials that are shipped and received by Client have a quality, quantity or any issue, Client agrees not to hold BGD responsible in any form or way. BGD will work with the print vendor used to resolve the issue and expedite a solution as best possible. Client is required to send BGD, as proof, a sample(s) by mail or send a photo of the issue. Client understands that this will add time to receive any new replacement materials requested. BGD will explore all options to resolve.
Client agrees to abide to a print vendors Terms and Conditions.
Request from Client regarding USPS postage mailing of i.e. postcards, mailers, etc. will need to be discussed on a per project basis. Please contact BGD first with such requests or related questions. A digital address list will need to be supplied from Client to BGD in a document TBD by BGD. BGD will not be responsible for any mistakes, losses of any form, etc. in the event of any issues.
Other
BGD agrees to deliver to Client; applicable final project file(s), any related necessary assets determined by BGD, and/or printed materials purchased by Client in order to fulfill a Client Plan purchased, custom hours purchased or otherwise discussed in electronic writing. Such file(s) for example include vector, raster, .eps, PDF, .jpg, .png and .svg. Native files are not included.
Native files: Client understands BGD is commissioned as a creative/design service to produce final deliverables as discussed/requested in the project brief, in email, or related documentation per project(s); and native digital files i.e. .psd, .ai .indd; remain property of BGD. Unless at request, Client agrees to pay a separate cost for native files TBD determined by BGD. BGD will deliver native digital files and any related assets necessary via e-mail or shared folder. BGD reserves the right to decline such request.
BGD is not responsible for any low-resolution images supplied from Client to BGD which may effect any final output quality.
Text/copy from Client is to be supplied to BGD in digital format i.e. standard text or Microsoft Word document via e-mail or shared folder.
Client agrees not to hold BGD and BGD will not be responsible for any damages or claims made by a third party regarding design or creative works made by BGD or any made claims of issues.
BGD reserves the right to refuse to produce or design anything deemed by BGD offensive, inappropriate or illegal.
Any art, images, content, media, documents, assets provided by a Client to BGD, Client understands and agrees that such is for reference only or for use. If for use, Client acknowledges they own copyrights or have obtained copyrights or permissions to use. BGD will not be responsible for any claims of related issues.
Client will fully own copyright to all works created by BGD. It is encouraged for Client to register their own filings for Trademarks and/or Copyrights it sees necessary for their business.
BGD reserves the right to use any creative work/design(s) developed by BGD for self-advertising or portfolio on budgetgraphicdesign.com, online, digitally, social media or offline.
Any stock photos/illustrations/media/assets used in a Client Plan purchased will follow Terms of Service of that source and Client agrees to abide by.
BGD reserves the right to edit or update Terms of Service at any time without prior notice. These Terms of Service replace any previous Terms of Service distributed, communicated or shared in any form. BGD reserves the right to change any Plan costs or terms of Plans at any time.
BGD office hours are 9:00 AM-5:30 PM eastern time. Closed most major holidays.
